Terms and Conditions
Clause 1 - Purpose
These Software Terms and Conditions ("Terms and Conditions" or "T&C") govern your access to and use of the YourStep Software (the "Platform"), provided by Your Step (YOUR STEP or "we" or "us") for you. These Terms and Conditions are effective (binding) upon your acceptance and will continue to apply for as long as you are a user of the Platform.
By your acceptance, you confirm that you have carefully read the contents of these T&Cs, and have understood the contents thereof.
Clause 2 - Definitions
In these Terms and Conditions, the following terms shall have the following meanings:
- Software AND Platform: correspond to the YourStep Software, which allows you to perform your academic tracking.
- User: You, i.e. the person who, by registering with YourStep, may use the Platform.
Clause 3 - Access to the Service
The Platform offers a free option for use, but also has paid features that require a monthly or annual subscription. The prices are €3.99 per month for the monthly subscription and €29.99 per year for the annual subscription.
The use of the contents and access to the Platform are your responsibility, so you must undertake not to perform any action that may damage our image, interests and/or rights in any way, as well as the normal use of the Platform.
YourStep does not guarantee the absence of viruses or other harmful elements that may cause damage or alterations to the computer system, electronic documents or user files on this Platform. Consequently, YourStep is not liable for any damages that such elements may cause to the user or third parties.
The Platform is accessible remotely and immediately via the Internet. Therefore, there is no geographical or time limitation for access to it.
You are responsible for the custody and confidentiality of your user and passwords to access the Platform, being, therefore, responsible for all consequences or damages arising from fraudulent or improper use of them. If you suspect that your username and password may be known by others, please change your passwords immediately and inform us at support@yourstep.ai, so that we can verify that no damage has been caused to the Software.
Clause 4 - Limitations on Use
You may only use the Platform for academic purposes, and not for commercialization, in accordance with generally accepted morals and good customs and public order.
Therefore, you may not:
- Allow the use of the Platform by third parties, for any purpose other than the satisfaction of the object of this Agreement;
- Use the Platform in a way that harms YOUR STEP or its distributors and/or suppliers, any customer of YOUR STEP, or other Users;
- Engage in, facilitate or promote illegal conduct; - Give any Service or the Platform itself for lease, rental or loan, nor may you resell, distribute or host it to any third party;
- Copy or reproduce any portion, feature, function or user interface of the Software; - Hinder or disrupt the integrity or performance of the Platform;
- Use the Platform to interfere with or damage a third party's system or environment;
- Access the Platform to create a competing product or service with the Platform, or reproduce or copy part or all of the Platform for the creation of a program or application of your own;
- Use any unauthorized means to modify or reroute the Software/Service, or attempt to modify it, or circumvent any technical limitations of the Platform;
- Perform any of the actions listed above including but not limited to reverse engineer, modify, decompile, disassemble, translate, version, commercialize, duplicate or transmit to any person or entity, in whole or in part, in any form or by any means, whether mechanical, magnetic, photocopying or otherwise, or remove any proprietary notices or labels from the Platform, the logic diagrams, source codes, object and/or data model, without YOUR STEP's express prior written permission.
- If you are logged in with your Google Account: YourStep's use and transfer to any other application of information received from the Google APIs shall be in accordance with the Google API Services User Data Policy, including the Limited Use requirements.
You shall be responsible for any malicious use that violates or exceeds the Usage Limitations.
Clause 5 - Intellectual and Industrial Property
YOUR STEP is the owner of all intellectual and industrial property rights of its property. Nothing in this Agreement shall be construed as an assignment or transfer of such rights in your favor. In particular and without limitation, it is agreed that nothing in this Agreement shall be construed as an assignment or transfer of any intellectual property rights in YOUR STEP, any development thereof or the YOUR STEP platform to you.
The Software and the Platform, its use and the elements that comprise it are the exclusive property of YOUR STEP and is protected by the laws and international treaties on intellectual property, including, but not limited to, any of its versions and modules, source or object code, graphic interfaces, databases, structure, design, images, sounds, texts, manuals, diagrams or other components. Failure to comply with the provisions of the applicable regulations and these conditions will give rise to the exercise of the corresponding civil or criminal actions for infringement of rights. In this case, apart from the corresponding compensation for the above acts, you agree to bear all the costs that the exercise of the corresponding actions entails, including the fees and rights of the lawyer and court attorney even if their intervention is not mandatory.
Clause 6 - Warranties and Confidentiality
YOUR STEP may make changes to the Platform for the inclusion of new modules, functionalities or remove some, as well as customization and updates, without involving a change in these T&C.
All information you include in the Platform will be treated by YourStep confidentially, applying the security measures deemed necessary according to the type of information you share with us.
Clause 7 - Force majeure
The Platform has been checked and tested for proper operation. In principle, it can be guaranteed to function correctly 365 days a year, 24 hours a day. However, YourStep does not rule out the possibility of certain programming errors, or the occurrence of force majeure, natural disasters, strikes, or similar circumstances that make it impossible to access the website.
Clause 8 - Protection of personal data
Your personal data will be processed by YourStep in accordance with the Privacy Policy.
Clause 9 - Communications
Whenever you want to contact us for any problem you may have with the Platform, you can do so by e-mail at support@yourstep.ai.
Clause 10 - Jurisdiction and Applicable Law
This Agreement shall be governed by, construed and enforced in accordance with Spanish law and shall be subject to the Courts of Madrid.
